Court: SC gives Gilani seven days to refile review plea against his conviction, disqualification

ISLAMABAD: A three-member Supreme Court bench on Wednesday gave seven days time to former Prime Minister Yusuf Raza Gilani to refile his review petition against his conviction and disqualification by a seven member larger bench of the apex court.

The bench comprising Chief Justice Iftikhar Muhammad Chaudhry, Justice Gulzar Ahmed and Justice Sh. Azmat Saeed, told Gilani that as per rules and procedures‚ his review petition will be heard by a seven member larger bench which had convicted him.

Appearing in person, Gilani told the court that he wanted that his disqualification be withdrawn. The chief justice told him that he was convicted by a seven judge bench and he did not challenge his conviction.

Gilani contended that the court had referred the matter of his disqualification to the National Assembly Speaker and the Speaker had ruled that his conviction did not warrant to his disqualification. He said, later, the ruling of the Speaker was challenged and consequently he was disqualified. To a court query, he said he had filed the review plea against his disqualification.

The chief justice told him that the decision which convicted him Gilani still held the field and on the basis of that decision he was disqualified. To the court’s insistence, Gilani said he wanted to file a review plea against his conviction. The court then directed him to file his review plea against his conviction within seven days. The court noted that a seven judge bench headed by chief justice will be constituted to hear Gilani’s review plea next week.
