Comments sought for release of two prisoners on parole

KARACHI: The Sindh High Court (SHC) on Wednesday issued a notice to provincial home secretary and superintendent Karachi Central Prison to file comments on a petition of two convicts in kidnapping for ransom case seeking their release on parole.

Two brothers – Muhammad Shahid and Muhammad Zahid – were found guilty of holding a trader for ransom and sentenced to death by Anti-Terrorism Court (ATC). Later, SHC converted their capital punishment into life-term after being approached by them.

Two convicts moved SHC through their counsel impugning the letter of home department that rejected their request for release on parole.

Counsel for petitioners said that his clients were eligible for the release on parole as they have undergone 10 years of imprisonment.

Besides, they have got 15-year remissions for behaving well in the penitentiary and passing various examinations including Nazira Quran.

He said that they filed an application with ATC requesting it to order their release on parole but it, after conducting hearing on application, referred this matter to home secretary.

However, he said, the home department through letter issued on August 20, 2012 rejected their request contending that they were not eligible for release on parole as they have not served required period of time.

Dispelling the claim of home secretary regarding convicts’ eligibility, he argued that they were eligible to be released as they have undergone 10-year period of imprisonment and got remissions. Therefore, he requested the court to declare the letter of home department as illegal and order his their release on parole.

After initial hearing, the court issued notice to official respondents asking them to submit their comments on the petition by August 4.
