SHC restrains PCSIR from taking final decision regarding promoting Grade-19 officers

KARACHI: The Sindh High Court on Tuesday conditionally allowed the Pakistan Council of Scientific & Industrial Research (PCSIR)’s departmental promotion board to conduct its proceedings to consider the promotions of grade-19 officers. However, it was restrained from making final decision unless it is permitted by the court.

A division bench headed by Justice Sadiq Hussain Bhatti gave this stay order while hearing a petition filed by an officer of PCSIR challenging the PCSIR’s notification regarding constitution of the departmental promotion board.

The court issued notice to the Ministry of Science and Technology’s secretary, PCSIR’s chairman and director to submit their comments on the petition by July 07.

Petitioner Dr Riazuddin submitted that the chairman of PCSIR issued a notification dated June 03 through which a departmental promotion board was constituted to consider the promotion cases of grade-19 officers and the PCSIR chairman was appointed its head.

He stated that PCSIR chairman is a competent authority to consider and decide the promotion cases of grade-17 to 19 officers but there was no relevant provision which empowers the chairman to head the promotion board considering cases of grade-19 officers. Therefore, he argued, every action on his part shall be deemed unlawful and unconstitutional.

He pleaded with the judges to suspend the PCSIR’s notification regarding constitution of the departmental promotion board. The court was further requested to issue directives for the federal authorities concerned to constitute the board afresh.
