SHC seeks comments on petition of accountant general SindhJuly 21, 2014
KARACHI: The Sindh High Court (SHC) on Tuesday issued notice to federal authorities on a petition filed by accountant general Sindh, Muhammad Ashraf Shaikh through which he questioned the legality of notification regarding his removal from the post.
Shaikh through his counsel approached the court citing federal establishment division secretary, secretary finance, auditor general of Pakistan and controller general of accounts as respondents.
In the petition, he submitted that establishment division secretary and controller general of accounts issued a notification on July 15 removing him from the post and asking him to report to the office of auditor –general. They issued another notification on July 16 for appointment of other officer of Pakistan audit and account services group on the slot.
However, he said, both notification were held in abeyance by audit-general through an order issued on July 16.
He said that he was appointed on the post by audit-general on May 9, 2013, adding that as per the relevant laws and service rules, establishment division secretary and controller general of accounts did not have powers to issue notification for his transfer as such powers only vested with auditor-general.
He requested the court to declare the both notifications as illegal and direct relevant authorities to refrain from issuing unlawful notifications.
After initial hearing, the division bench headed by Justice Muneb Akhtar issued notice to respondents and federal law officer to file comments.
