Accused Shahrukh Jatoi files petition to transfer case to session’s court

Karachi: Shahrukh Jatoi, prime accused in Shahzeb Khan’s murder case has filed a petition at Sind High Court SHC for transfer of the case to a regular court.

Shahrukh Jatoi, along with Siraj Talpur, Sajjad Talpur, and their cook Ghulam Murtaza Lashari, have been accused for murdering the 20yearsold in his car over a minor dispute near Mubarak Masjid in Phase of the Defence Housing Authority in the early hours of December 25, 2012.

The petitioner, Shahrukh Jatoi, through his counsel has challenged the decision of antiterrorism court ATC, whereby ATC dismissed the application seeking transfer of case. The petitioner submitted that Investigation Officer under the influence of media campaign has added Section 7 of the Antiterrorism Act 1997 in the charge sheet. However, he added that content of the FIR lodged against him and other accused in murder case do not contain the any element of terrorism.

It was submitted in the petition that complainant and all the prosecution witnesses of the case have not stated in their 161 and 164 Cr.PC statements that the accused has committed terrorist act as it was the case of quarrel between the parties. Therefore, he said that this murder case should be tried by a session’s court.

The petitioner submitted that he has never been nominated in any criminal activity before nor he has any connection with the banned outfits, hence the charge sheet filed in ATC was illegal and unlawful. He has pleaded court to set aside the order of ATC regarding transfer of case and it may be transferred to a session’s court.
