Court: Levy could not be imposed through a presidential ordinance: SCMarch 13, 2013
ISLAMABAD: The Supreme Court on Wednesday held that levy could not be imposed through a presidential ordinance, adding that it could only be imposed through an act of parliament.
A three-member bench comprising Justice Jawwad S. Khawaja, Justice Khilji Arif Hussain and Justice Ejaz Afzal Khan, was hearing a plea against the levy imposed on petroleum products through a presidential ordinance.
The court issued notices to the Attorney General Irfan Qadir and asked the senior advocate Anwar Kamal to assist the court as amicus curiae on the issue. Anwar Kamal told the court that interpretation of Article 177 was required to resolve the issue. He also sought time, which the court granted and adjourned the hearing until March 26.
