Illegal custody case: SHC Larkana imposes Rs 100,000 fine on SHO

RATODERO: Sindh High Court (SHC) Circuit Court Larkana on Tuesday imposed special cost of Rs100,000 on Inspector Taufique Ahmed Sadhayo, SHO, Rahmatpur police station, Larkana for illegally confining two youngsters in police lock up.

It directed IGP Sindh to adopt appropriate measures to reform his department by eradicating such highhandedness and excess. According to the criminal Miscellaneous application No D-111 of 2013 filed by Saeeda, wife of Muhammad Yousif Shaikh, resident of Bazigar mohalla, Larkana, through her advocate Nisar Ahmed Abro that on 26.5.2013 early in the morning at about 5.30am, SHO Rahmatpur police station along with his subordinates raided the house of the applicant, caused damage to house hold articles, disgraced womenfolk by hitting them kicks and fists and arrested applicant along with her two Shahzad Ali and Sagar Ali.

However after extorting Rs 20,000, SHO released the applicant leaving behind her two sons. On 29.5.2013, Bashir Ahmed Ansari, PA to the Court, was appointed as raid commissioner to pay surprise visit at police station Rahmatpur, who reported on 31.5.2013 that alleged detenus were found detained in the said police station without any case or FIR and got released both detenus.

SHO said that both detenus were arrested on the complaint of Saddiq Ali Arain for borrowing an amount of Rs56,000 from him but did not refund, hence, he admitted that both the detenus were arrested by him and kept in police lock up for safe custody. The court observed that admittedly the detenus were detained in wrogful custody by the police for a period of 4/5 days which was a grave violation of fundamental rights as guaranteed by the Constitution of Pakistan, 1973. The court further ordered that detenus may lodge FIR/complaint against incumbent/respondent SHO, if they so desire. The amount will be deposited in the Registrar’s office which will be given to both the detenu brothers equally.
