SHC allows Shirazi brothers to contest by-polls

Karachi: Sindh High Court SHC on Wednesday allowed Shirazi brothers of Thatta to contest the upcoming by-elections. A full bench of SHC headed by Justice Muneeb Akhtar, also issued notice to returning officer of NA237, Election Commission of Pakistan ECP, provincial election commissioner, Shamsunnisa and Abdul Aziz Memon and adjourned the hearing of case to August 6.

Shirazi brothers of Thatta, Syed Riaz Hussain Shah Shirazi and Syed Fiyaz Hussain Shah Shirazi, were disqualified by the election tribunal on the application of Shamsunnisa, who approached election tribunal against acceptance of Shirazi brother’s nomination papers.

Shirazi brothers submitted that election tribunal disqualified them on basis that they had encroached forestland. The petitioners said that in a report submitted by forest officer Thatta district it was alleged that they have encroached 80 acres forestland.

They said that rival candidate had attempted to implicate them in encroachment cases, though they added that detailed report submitted by chief conservator of forest confirmed that they were not involved in such activities.

The petitioner said that judgment of election tribunal is incorrect and pleaded the court set aside the judgment. They also prayed the court to direct returning officer to accept their nomination papers and allot them election symbol.

The court through an interim order directed the returning officer of NA237 in Thatta to accept nomination papers of Shirazi brothers and allot them election symbol.
