SHC asks ECP not to issue notification of PS85 polls

Karachi: The Sindh High Court SHC on Monday barred Election Commission of Pakistan ECP from issuing official notification of a successful candidate on a Sindh Assembly seat PS85 in Thatta.

The petitioner Sassui Palejo, who contested elections from constituency of provincial assembly PS85 but could not win, moved the SHC against her rival candidate, Syed Ameer Haider Shah Shirazi, stating that elections laws have been violated during counting of votes in her constituency at behest of Shirazi.

She alleged that votes in her constituency had not been counted properly, adding that wilfully her votes have been reduced while enhancing her rival candidate’s votes. She submitted that presiding officer did not bothered to provide her polling agents a certified copy of counted votes of 121 polling stations of PS85 constituency as it was mandatory according to related laws.

She alleged that results of her constituency had been engineered in favour of her rival candidate. She said that as per unofficial results, she lost provincial assembly seat from margin of 826 votes which was reduced to 408 votes after recounting of votes.

She held the stance before the court that votes of various polling stations were still missing. If a proper recounting is ordered, she might emerge victorious, she claimed.

Citing ECP, district returning officer, returning officers of PS85, and rival candidate Syed Ameer Haider Shah Shirazi as respondents, she prayed to court to restrain ECP from issuing official notification and ECP be directed to initiate proper proceedings in this respect.

A division bench headed by Justice Maqbool Baqar issued notice to the respondents and adjourned hearing to May 24. It also asked the ECP not to issue official notification of a successful candidate on a Sindh Assembly seat PS85 in Thatta.
