SHC directs restoration of academic activities in schools of Larkana district

Ratodero, Sindh: The Sindh High Court Circuit Court, Larkana, has directed the Regional Director Schools, Larkana Region, that there should be no obstruction or hindrance in all academic institutions at all level in Larkana district and that usual timings of all such institutions should be strictly followed by the entire faculty.

This direction was ordered during the hearing of Constitutional Petition No:1021 of 2013 filed by lawyer Qadir Bux Bhatti through his advocate Habibullah G. Ghouri.

The order further said that the respondents may coordinate with each other so that this order may be implemented in letter & spirit.

SHC further directed to submit weekly report to this Court jointly prepared & signed by them, wherein they shall point out all the steps taken by them for implementation of this order. Principals and Head Master of educational institutions were also directed to ensure that classes in their respective institutions are conducted regularly, punctually without any hindrance and strictly as per the office timings of their institutions. In case any of their teachers refuse, fails or neglects in performing his/her duties, appropriate action should be taken against him/her in accordance with the law which may also include disciplinary action.

Respondents were further directed to approach the Law Enforcement Agencies in accordance with the law in case of any obstruction/hindrance in the classes, unlawful assembly inside or outside of any of the institutions unlawful procession etc.

The court also appointed Asif Ali Soomro, President High Court Bar Association, Larkana, as amicus in this case to assist the court.

Abdul Hamid Bhurgari, Additional Advocate General was also present in the court.

The petitioner maintained that because of private dispute between the president Government Secondary Teachers Association GSTA district Larkana and the additional commissioner, office-bearers of said association were raising protests against the administration, due to which the classes of all the Primary & Higher Secondary Schools were being closed and the students sent home without attending their classes.

It was prayed inter alia in this petition that the respondents may be directed to ensure that complete school hours/timings should be observed and proper education to all the students of Larkana district should be provided and to restrain the respondents from closing the schools & colleges during school hours.

The case has been adjourned to 12.9.2013.
