SHC issues notices on petition against rehiring of retired employees in KU

Karachi: The Sindh High Court SHC has directed chief secretary, chancellor and vice chancellor of University of Karachi, registrar of university and other respondents to submit their respective replies in a petition against appointments of retired employees on contractual basis in the University.

Petitioner, Shoukat Ali submitted that respondent’s registrar of university, Mansoor Ahmed, director finance Qazi Zafar Abbas and deputy director finance, Minhaj Gilani have been appointed on contractual basis in violation of the university rules.

He said that vice chancellor had no authority to appoint any retired person on the contractual basis. He further stated that the VC had the authority to create and fill temporary posts for a period not exceeding six months, but his all actions would be subject to approval of the syndicate because they need to be in compliance with the act and statutes of the university.

He said that retired persons were also appointed in violation of the university code and the Supreme Court orders, adding that apex court had ruled that retired persons cannot be rehired against sanctioned posts, which is likely to affect the junior officers waiting for their promotions.

The petitioner prayed to court to direct chancellor of the university to immediately terminate the services of retired persons appointed on key posts and comply with the orders of the Supreme Court, whereby it had ordered dismissing of all rehired retired employees on contractual basis.

After hearing initial arguments of the petitioner, the division bench of SHC headed by Justice Ghulam Sarwar Korai issued notice to respondents chief secretary, chancellor and vice chancellor of University of Karachi, registrar of university, director and deputy director finance of the university.

The hearing of case was adjourned to a date later be fixed by court office.
