SHC orders stopping salary of interior secy

Karachi: The Sindh High Court SHC has ordered authorities to withhold salary of the Interior Secretary till further orders for his contumacious conduct towards court.

This direction came on a petition filed by Mst Naseema, widow of Haji Razzaq Memon, who moved the court for apprehension of Muhammad Naseer Khan from UAE as he committed fraud of Rs360 million with them. Earlier, the court had directed authorities concerned to issue arrest warrants and assure that accused is arrested within shortest possible time.

However, despite lapse of number of months court’s orders were not complied with and again court ordered FIA official not below rank of deputy secretary from Ministry of Interior to appear before court but none was present from ministry on day of hearing.

After that the court had directed secretary of Ministry of Interior to ensure that red warrants were issued for arrest of accused. The court observing that despite various directions no one has effected appearance on behalf of ministry, had issued show cause notices to secretary Ministry of Foreign Affairs as well as secretary of Ministry of Interior to explain their conduct.

Though on next date of hearing neither secretary of Ministry of Interior nor any one on his behalf of appeared. However Shiraz Iqbal Choudhry standing counsel stated that he has received a letter and a copy of affidavit which stated that Javed Iqbal secretary of Ministry of Interior has taken charge on April 23, 2013 and order of the court was brought to his notice and same has been implemented in letter and spirit. On the other hand representative of ministry of foreign affairs denies such position as stating that till May 6, 2013 ministry of foreign has not received extradition file from ministry of interior.

Besides, counsel appearing on behalf of petitioner, Wazeer Hussain Khoso stated that the ministry of interior is plotting with accused as he was influential personality.

The court observed that attitude of secretary Interior was contumacious and cannot be tolerated. It directed Accountant General of Pakistan to withhold the salary and all other emoluments of Javed Iqbal, secretary ministry of interior till further orders.

The court also cautioned that in case he does not appear on next date of hearing before court and file affidavit reflecting compliance of court orders, it would issue warrants for his arrest.

The hearing of case was adjourned to May 21.
