SHC restrains FIA from taking adverse action against 4 fruit/veg exporters

Karachi: Sindh High Court SHC has restrained the Federal Investigation Agency FIA authorities from taking any adverse action against as many as four fruit and vegetable exporters.

A division bench of SHC, headed by Ghulam Sarwar Korai also ordered that no final order shall be passed in the inquiry, relating to embezzlement of Export Development Fund EDF by exporters and Trade Development Authority of Pakistan TDAP officials, conducted against petitioners till further orders.

The petitioners, Nazir and Sons and other three exporters submitted that ministry of commerce had introduced 25pc freight subsidy to promote export of new products to new markets while covering period for this export was 200205.

They said that FIA lodged the inquiry against the Trade Development Authority of Pakistan TDAP officials, exporters and others for their alleged involvement in misappropriation of funds.

They said that certain exporters submitted fake freight subsidy claims and got payments. However, they added that they had fulfilled all formalities and obtained their claim after eight years. The petitioners further submitted through their counsel, Noor Alam that they have nothing to do with the alleged corruption but were being persecuted by the FIA authorities.

They prayed to court to direct the FIA authorities to stop inquiry against them and not to harass them.

The court also issued notice to secretary ministry of Interior, secretary ministry of commerce, director general FIA and deputy attorney general, asking them to file comments.
