SHC stays notification of winning candidate on PS29

Karachi: The Sindh High Court SHC on Thursday stayed the notification of winning candidate on provincial seat PS9 Shikarpur.

A division bench headed by Justice Faisal Arab gave direction while hearing the petition filed by Zulfiqar Ali Kumario, candidate from PS19 in Shikarpur, who lost provincial seat to Agha Siraj Durrani of Pakistan Peoples’ Party PPP.

The petitioner, Zulfiqar Ali Kumario, submitted that his voters were threatened by the workers and supporters of the rival PPP candidate and his polling agents were not allowed to enter the polling stations by the police.

He also alleged that the rival candidate’s supporters also destroyed the ballot boxes that contained votes in his favour.

The petitioner stated that he also lodged a complaint with the ECP against the rigging, but the commission did not take any action in this regard. He said that total registered votes in constituency are 129438 out which according him 56.85 percent votes were casted which stands 73586 votes.

He said that official results showed that 72955 votes were casted which were less than 56.85 percent casted votes. The petitioner said that he lost seat to Durrani with margin of 6 hundreds votes. He said that if votes are correctly recounted he emerge victorious.

He said that his application in this respect was pending which is likely to be decided in two weeks. He prayed to court to direct ECP to decide the application in one week and restrain commission from issuing notification.

The court stayed the notification and directed ECP to decide the matter of petitioner within in one week. The court while hearing the another petition filed by Illahi Bux Soomro who lost national assembly seat NA208 to PPP’s Ijaz Jakhrani, directed the ECP to decide his matter pertaining to allege massive rigging in his constituency.
